SUL CASO GEERT WILDERS - RISPOSTA DELL'AMBASCITA
A tutti coloro che hanno inviato messaggi ad ambasciata e consolati olandesi in Italia a proposito della causa contro l'On. Geert Wilders: Ringraziamo per il messaggio ricevuto e rispondiamo come segue: Per il caso di Corte Wilders nel settembre 2009, la Corte d'appello di Amsterdam ha ordinato il criminale perseguimento del signor Geert Wilders, membro del Parlamento olandese, per incitazione all'odio e discriminazione basata sulle sue dichiarazioni in varie circostanze sui musulmani e la loro fede.
Diverse persone e organizzazioni gli avevano intentato causa. Nel giugno 2008, il pubblico ministero aveva stabilito che le sue dichiarazioni non erano contro la legge e che il caso era chiuso, ma la parte attrice si č appellata contro questa decisione dinanzi alla Corte d'Appello.
La Corte d'appello ha stabilito che identificare l'Islam con il nazismo garantisce l'azione penale per offesa ai credenti musulmani. La Corte d'appello non ha fatto condannare il signor Wilders di un reato, ma ha ordinato al pubblico Ministero di avviare una procedura penale contro di lui al primo distretto della Corte di Amsterdam.
Il 13 gennaio, la Corte distrettuale di Amsterdam ha respinto una proposta del Signor Wilders per limitare le accuse contro di lui. La Corte ha stabilito che l'atto d'accusa era in linea con la decisione della Corte d'appello e che non c'erano fatti nuovi che darebbero motivo di limitare l'ambito di applicazione della atto d'accusa.
Il 20 gennaio, la Corte distrettuale di Amsterdam inizierā il procedimento del caso. In definitiva, il Signor Wilders ha recato offesa.
La Corte d'appello e la Corte distrettuale sono completamente indipendenti dal governo olandese.
La procedura č in corso, ogni ulteriore commento del Governo del Paesi Bassi sul caso, sarebbe inopportuno.
Il Signor Wilders rimane un membro del Parlamento e proseguirā il suo lavoro mentre il caso passa attraverso il processo legislativo.

In September 2009, the Court of Appeal in Amsterdam ordered the criminal
prosecution of Mr. Geert Wilders, Member of the Dutch Parliament, for
incit ing hatred and discrimination based on his statements in various
media about Muslims and their faith. Various people and organisations
had asked for his prosecution. In June 2008, the Public Prosecutor had
determined that his statements were not against the law and had dropped
the case, but the plaintiffs appealed this decision before the Court of
Appeal.
The Court of Appeal determined that statements equating Islam to Nazism
warrants prosecution for insulting Muslim believers. The Court of Appeal
did not convict Mr. Wilders of a crime, but ordered the Public
Prosecutor to start a criminal procedure against him before the District
Court of Amsterdam.
January 13th, the District Court in Amsterdam dismissed a motion made by
Mr. Wilders to limit the charges against him. The Court ruled that the
indictment was in line with the decision of the Court of Appeal and that
there were no new facts that would give reason to limit the scope of the
indictment. On January 20th, the District Court in Amsterdam will start
the proceedings in the case. Ultimately, it will decide whether or not
mr Wilders has committed a criminal offense.
The Court of Appeal and the District Court are fully independent from
the Dutch government. As the procedure is ongoing, any further comment
by the Netherlands government on the case itself would be inappropriate.
Mr. Wilders remains a member of parliament and will continue his work
while the case goes through the legal process.
